Terms & Conditions

The terms on which Medtech Healthcare Sdn Bhd supplies products, teleconsultations and pharmacy services to retail customers and approved trade accounts in Malaysia.

1. These terms

These terms apply every time you order from us or use our services, whether through this website, WhatsApp, email or in person. Please read them before you order. By placing an order or booking a consultation you accept them. If you do not accept them, please do not order.

Two other documents form part of these terms: our Shipping Policy and our Refund & Return Policy. Our Privacy Policy explains how we handle your data.

2. Who can buy

You must be at least 18 years old to buy from us or to book a consultation. Medicines or consultations for a child must be arranged by a parent or guardian. We may decline or cancel any order at our discretion, including where we believe a product is being bought for resale without a trade account, or in a quantity inconsistent with personal use.

3. Accounts

Retail accounts

You are responsible for keeping your password confidential and for everything done through your account. Tell us immediately if you think someone else has access to it. Because your account may contain clinical information, please do not share your login.

Trade accounts

Wholesale pricing is available only to businesses whose trade account application we have approved. Applications require valid SSM registration and, where relevant, a valid clinic or pharmacy licence. Approval is at our discretion, and we may set, vary or withdraw a credit limit and payment terms at any time. Wholesale prices and trade catalogues are confidential and must not be shared outside your business.

4. Products and information

We take care to describe products accurately, but images are illustrative and packaging, appearance and manufacturer may change. Always read the label and the manufacturer's leaflet before use.

General product information on this website is not medical advice. It is not a substitute for a consultation about your own circumstances. If you are unwell, pregnant, breastfeeding, taking other medication or managing a chronic condition, speak to a healthcare professional before starting anything new.

5. Teleconsultation

  • Teleconsultations are provided by a registered medical practitioner, and pharmacy services by a registered pharmacist.
  • A teleconsultation is a clinical service. You are paying for the doctor's time and assessment, not for a particular outcome or a guaranteed prescription. The doctor may decline to prescribe, prescribe something other than what you asked for, or refer you for a physical examination.
  • Teleconsultation has inherent limits: the doctor cannot examine you physically. You must give accurate and complete information about your symptoms, history, allergies and current medication. We are not responsible for clinical decisions made on the basis of information that was incomplete or incorrect.
  • Teleconsultation is not for emergencies. If you have chest pain, difficulty breathing, severe bleeding, signs of stroke, or any other emergency, call 999 or go to the nearest emergency department immediately.
  • We do not issue medical certificates online.
  • Consultation fees are payable in advance and are treated as set out in our Refund & Return Policy.

6. Prescriptions and regulated medicines

  • Prescription-only medicines and scheduled poisons are supplied strictly against a valid prescription — either one issued by our doctor following a teleconsultation, or one you present from your own registered medical practitioner.
  • Every prescription is reviewed and dispensed by our registered pharmacist before the order is released.
  • Our doctor or pharmacist may refuse or limit supply where it is clinically inappropriate, where quantities are excessive, or where a legal requirement is not met. This is a professional obligation and is not negotiable.
  • Quantity limits may apply to certain products.
  • Prescription items are not available through open online checkout.

7. Prices and tax

  • All prices are in Malaysian Ringgit (MYR).
  • The total payable, including any applicable Sales and Service Tax and delivery charge, is shown at checkout before you pay. Nothing is added afterwards.
  • Trade prices are those on your approved price list and may differ from retail prices shown on the public site.
  • Prices can change without notice, but a change will never affect an order we have already accepted.
  • If a price is obviously wrong through a genuine error, we may cancel the order and refund you in full rather than supply at that price.

8. Orders and acceptance

Your order is an offer to buy. A contract is formed only when we dispatch the goods, or, for trade accounts, when we confirm the order in writing. Until then we may decline the order — for example if an item is out of stock, if a prescription cannot be verified, if a credit limit would be exceeded, or if we suspect fraud. If we decline after you have paid, we refund you in full.

9. Payment

  • Online payments are processed by our payment provider CHIP (CHIP In Sdn Bhd), which supports FPX online banking, debit and credit cards, and e-wallets.
  • Card and banking credentials are entered directly with the payment provider. We never see or store your full card number, expiry date or CVV.
  • Goods remain our property until we have been paid in full.
  • Approved trade accounts pay on the terms stated on the invoice. While an account is overdue we may suspend deliveries, withhold further credit, or withdraw credit terms.

10. Delivery

Delivery destinations, timescales and charges are set out in our Shipping Policy. Risk in the goods passes to you on delivery.

11. Returns and refunds

Because we supply medicines, returns are restricted for patient-safety reasons. The full rules — including the cases where we will always refund or replace, and how consultation fees are treated — are in our Refund & Return Policy.

12. Acceptable use

You may not use this website to break the law, to interfere with its operation or security, to scrape or copy our catalogue or pricing, to obtain medicines by giving false clinical information, or to place fraudulent or automated orders. We may suspend or close any account used in this way.

13. Intellectual property

The content of this website — text, images, layout, our name and logos — belongs to us or our suppliers and may not be reproduced commercially without our written permission. Manufacturer brands and product images remain the property of their owners.

14. Our liability

We are responsible for loss you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care and skill. We are not liable for business losses such as loss of profit, loss of business or loss of goodwill, and our total liability for any order is limited to the amount you paid for it.

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for clinical negligence, for fraud, for defective products under the Consumer Protection Act 1999, or for anything else that cannot lawfully be excluded. Your statutory rights as a consumer are not affected.

15. Events outside our control

We are not liable for failure or delay caused by events beyond our reasonable control, including courier disruption, supply shortages, regulatory action, utility or network failure, natural disaster or public health measures.

16. Privacy

We handle your personal data, including clinical information, as described in our Privacy Policy.

17. Complaints

If something has gone wrong, contact us using the details below and we will look into it. Complaints about clinical care are reviewed by the treating doctor or pharmacist. Nothing in these terms prevents you from raising a matter with the Ministry of Health, the Malaysian Medical Council or the Pharmacy Board.

18. Changes to these terms

We may change these terms from time to time. The version that applies to your order is the one published when you placed it. The current version is always on this page.

19. Governing law

These terms are governed by the laws of Malaysia, and the courts of Malaysia have exclusive jurisdiction over any dispute arising from them.
